Yacht members warned to beware of repatriation loophole

3 September 2021

Nautilus International is asking yacht members to check their work contracts for a legal loophole that has been exploited by employers during the Covid-19 pandemic.

Nautilus director of legal services Charles Boyle warns that the Union has observed several cases of owners changing the repatriation destination in a seafarer's contract from their home address to the name of the country.

The owner would therefore no longer be responsible for any travel costs associated with repatriation from the time that the seafarer arrived in their home country.

The owner would also not be liable for any costs arising from Covid-19 restrictions in the country of arrival – such as compulsory hotel quarantine – meaning they would be borne by the seafarer instead.
